Officers have agreed terms for a Deed of Grant
giving vehicular access along North Drive, High Cross for a site
that has planning consent for the construction of 9 detached houses
(3/21/1910/FUL). North Drive is an unadopted road owned by the
Council that has a history of disrepair and surface water flooding
due to run-off from surrounding land and insufficient surface water
drainage. In return for the grant of vehicular access the developer
Osprey Homes (South East) Limited will pay the Council the sum of
£100,000 on completion and carry out an agreed schedule of
works to upgrade and repair the road and provide additional surface
water drainage both to the road and ancillary land. The value of
these works is in the region of £120,000. The majority of the
works will be carried out before the houses are developed with the
remaining area that will be affected by construction works being
completed within 3 months of the development completing. The
Solicitor for the Grantee will hold a sum of £20,000 for the
Council to draw on should the developer default on this later phase
of works. The works will be subject to a maintenance period of one
year from the date of completion. The granting of this access
provides a capital receipt for the Council and will improve and
upgrade the road surface and surface water drainage of North Drive
reducing future repair costs and flood risks for the Council.
