The Council previously entered into a deed of
covenant in respect of 111 Windmill Way, Much Hadham allowing the
Council to nominate tenants to the property as provided for by the
Nomination Deed. The property is now being sold by the current
owner Orbit Group Ltd. to B3 Living Limited and a condition of the
sale is that a new deed of covenant must be entered into by the new
owner obliging them to also comply with the Council’s
Nomination Deed. The purpose of this report is to seek consent to
enter into a new deed of covenant with B3 Living Limited.
The Head of Strategic Finance and Property,
acting under authority delegated by paragraph 10.13.16 of the
council's Constitution, has decided to
give approval to enter into a deed of covenant with B3 Living Ltd
in respect of nomination rights for 111 Windmill Way, Much
Hadham.
There are no other options. Parties to the
original agreement are obliged to enter into a new deed when
applicable.
