sell the property now that the liability to the council has been
paid for the Right to Buy Mortgage.
Head of Strategic Finance and Property acting
under authority delegated within Part 3c, paragraph 8.4 of the
council’s Constitution ‘Powers to incur capital and
revenue expenditure, to seek recovery of amounts owed, to exercise
discretion in recovery, alter or waive repayment periods or approve
exemptions in relation to repayments, agree refunds, reduce or
remit payments and waive fines, as detailed in the Financial
Regulations and Contract Procedure Rules in Part 4 of this
Constitution has decided to remove the charge from the property as
there is no liability outstanding.
Not applicable as no legal basis to maintain
the charge and unreasonably refusing to remove it would make the
council liable for compensation and damages
