The Council granted a 99 year lease in 1981
for the use of land adjacent to 16 Welwyn Road for granted purposes
in conjunction with the occupation of 16 Welwyn Road. The Tenant is
now deceased and probate has been granted to the the Tenant's
daughter who has requested that the Council grant consent for the
lease to be assigned to her. The lease allows for the lease to be
assigned subject to obtaining the Council approval, such approval
not to be unreasonably withheld.
The purpose of the report is to see approval for the Council to
provide consent by way of licence for the assignment.
The Head of Strategic Finance and Property has
decided to approve the grant of a licence giving consent for the
assignment of the lease for land adjacent to 16 Welwyn Road,
Hertford.
The only option would be to refuse to give
consent but there is no reason to do. There is no financial or
legal liability to the Council as a result of the assignment and
such a refusal is likely to be successfully challenged by the
applicant as being unreasonable.
